How can a CIO end up in jail?

CIOs need to be apprised of the provisions of the Cybercrime Bill and PoPI.

What can land a CIO in jail? This was the uncomfortable topic of discussion at this month’s CIO Council meeting in Johannesburg. As the legislative landscape shifts under the CIO’s feet, they can now be held criminally liable for contravening provisions in PoPI or the Cybercrime Bill.

It goes without saying that any CIO worth his or her salt will be apprised of the new legislation, but the room fell silent when Junaid Amra, an associate director at PWC, took the stage. Amra said a concept drawn from PoPI was what he termed ‘the aspect of minimality’, explaining that a company should only collect the information required, and no more.
